USER AGREEMENT

This User Agreement (hereinafter referred to as the “Agreement”) governs the use of the information systems of JSC “National Center for Professional Development ‘Orleu’” (hereinafter referred to as the “IS”), BIN 120740006206 (hereinafter referred to as the “Company”), and constitutes a binding agreement between the Company and any person using the IS (hereinafter referred to as the “User”).

1. General Provisions

1.1. By using the IS, the User fully agrees to all terms of this Agreement.

1.2. The Company may amend this Agreement, in whole or in part, at any time without prior notice. Any updated version of the Agreement takes effect immediately upon publication in the IS. Users are responsible for regularly reviewing the Agreement to stay informed of any changes.

2. Personal Data

2.1. By accepting this Agreement and providing personal data in accordance with the attached appendix, the User consents to the collection and processing of their personal data by the Company, including systematization, accumulation, storage (including for potential claims), updating, and modification; use for purposes such as individual communication with Users, sending advertising or marketing materials, invitations to events, conferences, exhibitions, or other purposes not prohibited by the laws of the Republic of Kazakhstan; disclosure, including transfer to third parties and cross-border transfer; anonymization, blocking, and destruction; placement or indication of personal data within the IS. By using the IS, the User also agrees to the Company’s Privacy Policy available within the IS.

3. User Rights and Obligations

3.1. The User must provide accurate, complete, and truthful information when registering in the IS.

3.2. The User must not post information or materials in the IS (including links) that may violate the rights or interests of the Company or third parties.

3.3. The User may use the IS in accordance with this Agreement and the laws of the Republic of Kazakhstan.

4. Company Rights and Obligations

4.1. The Company reserves the right to verify the accuracy of the information provided by the User if necessary.

4.2. In the event of repeated or serious violations of this Agreement or applicable laws, the Company may suspend, restrict, or terminate the User’s access to the IS.

5. Liability

5.1. The User is fully responsible for the accuracy of the information provided during registration.

5.2. The User agrees to compensate the Company for any proven damages or material losses caused by their actions or inaction when using the IS.

5.3. The Company is not liable for non-performance or improper performance of its obligations caused by: a) force majeure; b) changes or cancellation of regulatory legal acts; c) actions of government authorities or third parties; d) deterioration in the quality of services provided by communication operators; e) any other circumstances beyond the Company’s control.

6. Final Provisions

6.1. Any matters not regulated by this Agreement are governed by the laws of the Republic of Kazakhstan.

6.2. All disputes arising out of or in connection with this Agreement shall be resolved in the court at the location of the Company in accordance with the applicable law.

6.3. The Company’s failure to act in response to a violation of this Agreement by the User does not waive its right to take appropriate measures to protect its interests in the future.

Appendix

Consent to the Collection and Processing of Personal Data

I, as a User of the IS, hereby give my consent to the collection and processing of my personal data by JSC “National Center for Professional Development ‘Orleu”, BIN 120740006206 (the “Company”).

This consent is valid for the period necessary to achieve the purposes of data processing, as well as for the retention period established by the legislation of the Republic of Kazakhstan.

The purposes, types of data collected, possibility of transfer to third parties, cross-border transfers, and other matters relating to the processing of personal data are governed by the Company’s Privacy Policy and this User Agreement.

The dissemination of personal data in publicly accessible sources is not intended.

I have read and agree to the collection and processing of my personal data, as well as to all other actions outlined in the Privacy Policy and this User Agreement.
